Privacy Policy
This Privacy Policy governs the processing of personal data by INTELEK spol. s r.o., company registration number: 4944611, with registered office at Olivova 2096/4, Nové Město, 110 00 Prague 1, registered in the Commercial Register maintained by the Regional Court in Brno, Section C, Insert 12338, newly renamed INTELEK servis s. r.o, ID No.: 4944611, with registered office at Olivova 2096/4, Nové Město, 110 00 Prague 1, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 353200 and the successor company INTELEK.CZ s.r.o., IČ 14089459, with registered office at Olivova 2096/4, Nové Město, 110 00 Prague 1, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 360411 (hereinafter referred to as "INTELEK" or "Company") in connection with the use of the iGET FIT mobile application (hereinafter referred to as "Application").

INTELEK respects your right to privacy. If you use our mobile application, visit our website or otherwise communicate with us electronically, we will always take all necessary precautions and do our best to keep your personal data secure. The processing of personal data by us will always be in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("General Regulation" or "GDPR") and in accordance with Act No. 101/2000 Coll., on the protection of personal data and on the amendment of certain acts, as amended (hereinafter referred to as the "PDPA").

INTELEK undertakes to keep all personal data collected from persons using our application and using our online facilities and services in a true, confidential and secure manner, and only to the extent, for the purposes and for the period of time set out below. You can also find the policy on this processing in this document.

What personal data we hold about you:
INTELEK only processes your personal data on the basis of legal or contractual authorisation, consent given or legitimate interest. INTELEK will only ever use the personal data you provide to the extent listed below:

- login data (e-mail address and password),
- address data (country/region),
- gender,
- date of birth,
- height and weight data,
- information related to your sports performance and daily routine (e.g. number of steps, heart rate and pressure, sleep patterns and duration, calories burned, walking, cycling, swimming, etc.),
- Information about a specific device (for example, hardware model, operating system version, unique device identifiers, and mobile network information including phone number). INTELEK may associate your device identifiers with your account.

When you use our services or browse content provided by INTELEK, we automatically collect and store certain information in server logs. These include:

- Details of how you have used our service,
- information related to your sports performance and daily routine (for example, step count, heart rate and pressure, sleep patterns and duration, calories burned, walking, cycling, swimming, etc.).

When you use the iGET FIT App, we may collect and store information (including personal information) locally on your device in the app's data cache.

How we process your data when you use the iGET FIT app:
When you launch the app and connect wearables, you will be prompted to log into the app under an existing user account or to create one. When you create a user account, you will be asked to select a username, which is also the email address necessary to send you information regarding the app, as well as a login password and region. The username and password you select, along with the region, are stored on the Company's secure cloud server located in the Czech Republic with backups in Frankfurt, Germany.

After creating a user account, you will be prompted to fill in the data necessary for the proper functioning of the application and the provision of its functions. This includes your gender, height, weight and date of birth. The data provided in this way will not be disclosed to us and will only remain stored on your device unless you give your consent to transfer it to the company. Other personal data is only stored in the memory of the device and the Company does not process or access this data.
If you choose to do so, your personal data may be backed up on the Company's secure cloud storage located in the Czech Republic. However, this data will not be further processed by the company unless you provide your consent.

In the event that you choose to provide the Company with consent to the processing of your data, namely your gender, height, weight and date of birth, the Company will be entitled to use your data in an anonymous manner for its own purposes, in particular for the purposes of evaluating and comparing it with other users. We may then display this anonymous evaluation to you on the App. If you do not give this consent, this data will only be stored in the memory of the device and on the Company's secure cloud storage located in the Czech Republic with backups in Frankfurt, Germany, and will not be accessible by the Company.

What are the legal titles of the processing of your personal data:
The company processes your login data (email address and password) together with your address data because they are necessary for the proper functioning of the application, i.e. for the performance of contractual obligations.

If you choose to provide the company with consent to process other data about you, namely your gender, height, weight, date of birth, information related to your sports performance and daily routine (e.g. number of steps, heart rate and pressure, sleep patterns and duration, calories burned, walking, cycling, swimming, etc.), this personal data will be processed on the basis of the consent you have provided.

We may also send you news about the services you use with us based on the legitimate interest of the company or the consent you have given us. For example, if you register on the iGET FIT mobile app, we will send you news about the iGET FIT app. However, you can unsubscribe from newsletters and other marketing communications at any time (or modify the scope) via a link in each message we send you.

For what purposes we process your personal data:
The Company processes your login data for purposes necessary for the performance of contractual or legal obligations. We also store your personal data on cloud storage for backup purposes.

If you give your consent to this, the company is entitled to use the personal data you provide in an anonymous manner also for its own purposes, in particular for the purpose of evaluating and comparing it with other users of the app, this anonymous evaluation can then be displayed to you in the app.

From time to time, we may offer you the opportunity to participate in contests, promotional events and other promotions. Any information provided in connection with these activities will be processed in accordance with this Privacy Policy. From time to time, we may also ask you to participate in surveys to help us improve the App. Any personal information provided in connection with any survey will be used only for the survey in question and to third parties not bound by this Privacy Policy

Based on the legitimate interest of the company, the company is also entitled to process your email address for the purpose of sending you marketing communications.

To whom we disclose your personal data:
Your personal data will be processed by the Company. The Company will process your personal data manually and automatically, either personally or through its employees.

The Company may transfer your personal data to other processors to carry out processing for the Company for the above purposes. These processors are:

- cloud storage operator Satomar, s.r.o., ID: 29201586, with registered office at Šimáčkova 247/31, Líšeň, 628 00 Brno,
- a subsidiary of ASPRA a.s., ID No.: 25599089, with registered office at Ericha Roučky 1291/4, Černovice, 627 00 Brno.

We reserve the right to transfer all of your personal data in our possession to the successor organization in the event of a merger, acquisition, bankruptcy or other sale of all or part of its assets. You acknowledge that any such transfers may occur and that the successor organization or other acquirer may refuse to comply with its obligations under this Privacy Policy.

Personal Data Processing Period:
We will only ever retain your personal data for as long as is necessary for the purpose for which we obtained your data. Typically, this will be for the period of time that we are providing you with a service or for the period of time prescribed by law for us to retain it. Where we hold your data because you have voluntarily consented, we will keep it for the duration of your consent unless you withdraw your consent earlier.

For direct marketing purposes, personal data will be processed for a period of 5 years from the end of the provision of services.

How your personal data is secured:
Your personal data is under our constant physical, electronic and procedural control. We use state-of-the-art control, technical and security mechanisms to ensure that your data is protected to the maximum extent possible against unauthorised access or transmission, against loss or destruction, and against other possible misuse.

All those who come into contact with your personal data in the course of their employment or contractual duties are bound by a strict legal and/or contractual duty of confidentiality, which continues after their employment or contractual relationship with us has ended. We regularly check compliance with these obligations, including compliance with security requirements, both internally and with our suppliers to provide you with maximum assurance of well-protected data.

However, keep in mind that even the best security measures cannot completely eliminate all risks. Any data posted online is vulnerable to theft and misuse by unauthorized third parties. We cannot guarantee that only authorized persons will view your personal information. We are not responsible if a third party circumvents any privacy settings or security measures.

Your rights
You have the following rights in relation to our processing of your personal data:

- The right to access your personal data;
- the right to rectification;
- the right to erasure ("right to be forgotten");
- the right to restriction of data processing;
- the right to object to processing;
- the right to lodge a complaint about the processing of personal data.

Your rights are explained below to give you a clearer idea of their content.

The right of access means that you can ask us at any time to confirm whether or not personal data relating to you is being processed and, if so, for what purposes, to what extent, to whom it is disclosed, for how long we will process it, whether you have the right to rectification, erasure, restriction of processing or to object, where we obtained the personal data and whether or not automated decision-making, including profiling, is taking place on the basis of the processing of your personal data. You also have the right to obtain a copy of your personal data, the first provision of which is free of charge, and for further provision the Intermediary may require reasonable payment of administrative costs.

The right to rectification means that you can ask us to correct or complete your personal data at any time if it is inaccurate or incomplete.

The right to erasure means that we must erase your personal data if

- they are no longer necessary for the purposes for which they were collected or otherwise processed,
- the processing is unlawful,
- you object to the processing and there are no overriding legitimate grounds for the processing; or
- we are under a legal obligation to do so.

The right to restrict processing means that until we have resolved any disputed issues about the processing of your personal data, we must restrict the processing of your personal data so that it can only be stored and, where appropriate, used for the establishment, exercise or defence of legal claims.

Right to object means that you can object to us processing your personal data that we process for direct marketing purposes or on the grounds of legitimate interest. If you object to processing for direct marketing purposes, your personal data will no longer be processed for these purposes.

Changes to the Privacy Policy:
INTELEK reserves the right to update and/or change the terms of our Privacy Policy, and as such, we will post such changes on the home page of our website at www.iget.eu so that users and/or visitors are always aware of what type of information we collect, how it will be handled, and under what circumstances, if any, we may disclose such information. If, at any time, we decide to keep any personally identifiable information on file in a manner significantly different from that which was established when we obtained the information, the user or users will be notified immediately by email. Users have the option at that time to choose whether or not to allow their information to be used in this different manner.

You can file a complaint with the supervisory authority, which is the Office for Personal Data Protection (www.uoou.cz).

This Personal Data Protection Policy becomes valid and effective on 1.8.2018.
